Pumping at work: who has break and space protections
Qualifications and requirements: Most FLSA-covered nursing employees are entitled to needed pumping breaks and a private functional space, other than a bathroom, for up to one year after birth.
The space must be shielded from view, free from intrusion and available when needed.
Documents to prepare (confirm what is required): Requested break and space arrangements; Employer response and relevant policy; Schedule and work-duty records
Exceptions and checks: Specific small-employer and transportation exceptions may apply; an employer must meet the applicable exemption conditions.
Greater protections under other applicable laws remain possible.
Questions to ask: What space is actually available when I need it?; Am I relieved of work during the break?; Which coverage or exemption is the employer claiming?
Next steps: Request a workable pumping arrangement.; Document a denial or unusable space.; Ask DOL to assess the applicable protection and complaint route.
Limits: This explains federal coverage screening and does not decide an employer's asserted exemption.
