I need family or medical leave or was denied leave

Leave protections depend on coverage and eligibility; a medical need alone does not resolve every employment issue.

Qualifications & requirements

Source-backed qualifications and preparation information for all 15 topics, usable across all 75 Arkansas counties with the existing county routes. This is partial coverage, not an eligibility decision. Current income limits, program exceptions, local intake, funding and individual facts require confirmation. Who this is for / requirements to check

  • The reason must qualify, such as the worker's serious health condition, covered family caregiving, birth or placement of a child, or qualifying military-family leave. Source: DOL FMLA frequently asked questions

Forms, timing and where to file

Check that this filing path fits your actual papers and your role.

Match the procedure, your role and the actual papers before using a period or form. No personal due date is calculated. Current rules, service, exceptions and local filing requirements need confirmation.

Request leave and return medical certification

Your next steps

  1. Notify the employer through its leave-request process and ask whether FMLA applies.
  2. If certification is requested, give the appropriate provider the employer's requirements or DOL optional form.
  3. Return the completed certification to the employer's designated leave office and keep proof.
  4. Contact WHD if protected leave is denied or retaliation occurs.

What forms or applications do I need?

How much time do I have, and when must I file?

Published period — confirm applicability

Period: At least 15 calendar days to provide requested certification.

What starts the clock: Employer requests FMLA medical certification.

What to do: Return complete certification to the employer by the stated lawful date.

Exceptions and checks: Additional time applies when diligent good-faith efforts cannot meet the date; eligibility and other leave-notice rules are separate.

Authority: 29 CFR § 825.305(b); DOL Fact Sheet 28G · DOL medical certification timing ↗

Where and how do I file?

Receiving office: Employer's designated FMLA/leave administrator; WHD for enforcement complaint

Submission method: Employer-designated secure return method; do not send medical certification to DOL as the leave application.

Jurisdiction and venue: Employer leave administration applies statewide; an enforcement complaint goes to WHD rather than the county court.

Bradley County check: For all 75 Arkansas counties, confirm the actual receiving office and venue before filing. County of residence alone does not establish jurisdiction. Confirm current hours, accepted delivery, electronic access, fees or waiver options, and proof of acceptance or service.

Use the named agency, federal office or provider’s current instructions. County court filing contacts do not replace this submission route.

Before you submit: Verify signatures, attachments, current form edition, fees or fee-waiver process, service requirements, and whether the office must receive or accept the filing by the deadline. Keep the accepted copy or receipt and follow up on rejected submissions. A referral or phone call does not extend a separate deadline.

Limits: No medical eligibility finding or leave approval is supplied.

  3. Keep required certification requests and submission receipts privately.
  4. Ask DOL or qualified help whether the leave and employer are covered.

Questions to ask before acting

  • Is this about agreed wages, overtime, leave, discrimination, work injury or unemployment?
  • Which employer, staffing company or benefit administrator made the decision?
  • Does an internal grievance preserve the separate agency filing deadline?
  • What is the response method and deadline in my actual papers, and can I request language help, disability access or a fee waiver?

State and federal workplace routes have different coverage tests and filing periods. Internal complaints may not preserve an agency deadline.

Common mistakes to avoid

  • Do not treat every unfair firing or missed break as an unlawful act; coverage and facts differ.
  • Do not copy employer or coworker confidential files you are not authorized to access.

Before filing, applying or traveling in Bradley County

  • Identify the actual court, division, agency or provider from your papers. Your home county alone may not determine the correct venue or office.
  • Confirm accepted submission methods, current forms, required attachments, fees or waiver options, and any separate service or notice requirement with the responsible office.
  • Read the dates and instructions on the actual notice. Keep delivery records, accepted submission receipts and the next appointment or hearing information.
  • Ask early about an interpreter, disability accommodations, a safe contact method, remote participation or travel needs. Confirm who receives the request.
  • For representation, ask about issue coverage, income rules, conflicts and intake capacity. A referral or application does not mean a lawyer has accepted the case.
